1. Agreement to Terms
By accessing or using the Heavy Machinery and More website, mobile application, or any services provided by Network Marketer LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services Description
Heavy Machinery and More provides a platform for buying and selling used heavy equipment, machinery, trucks, and related items. We act as a facilitator connecting buyers and sellers and may also purchase equipment directly.
3. User Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your account information
- Not use our services for any unlawful purpose
- Not misrepresent the condition, specifications, or ownership of equipment
- Comply with all applicable local, state, and federal laws and regulations
4. Equipment Listings and Sales
All equipment listings are subject to availability and prior sale. Prices are subject to change without notice. While we strive to ensure accuracy, we do not guarantee that all equipment descriptions, images, specifications, or pricing information is accurate, complete, or current.
Equipment is sold "as-is" unless otherwise specified in writing. Buyers are responsible for conducting their own due diligence and inspection prior to purchase.
5. Telephone Consumer Protection Act (TCPA) Consent

How to Opt Out:
You may revoke your consent and opt out of receiving communications at any time by:

After opting out, you will receive a confirmation message and no further marketing communications will be sent to that number. Please allow up to 10 business days for your request to be fully processed.
Subscriber Confirmation:
By providing a telephone number and submitting any form on our website, you represent and warrant that:
- You are the subscriber to the telephone number(s) provided, or you are the customary user of that number and are authorized to provide consent
- You are at least 18 years of age
- The telephone number(s) provided are accurate and currently in service
- You will notify us immediately if you change or relinquish the telephone number(s)
6. Third-Party Partners and Contractors
We may share your information, including your telephone number and consent status, with trusted third-party partners, contractors, and service providers who assist us in operating our business. These parties may contact you on our behalf and may include:
- Equipment dealers and resellers in our network

- Equipment inspection services

Notice: By using our services and providing your consent, you acknowledge and agree that your personal information may be shared with our partners and contractors who may contact you regarding equipment, services, or offers. 7. Do Not Call Policy
We maintain an internal Do Not Call list. If you wish to be added to our Do Not Call list, you may:
- Reply STOP to any text message
- Call (757) 508-5894 and request to be placed on our Do Not Call list
- Email info@heavymachinaryandmore.com with "Do Not Call" in the subject line
- Submit a request through our Opt-Out page
Requests will be honored within 30 days, though we strive to process them within 10 business days. Note that even after opting out of marketing communications, you may still receive transactional or informational messages related to your specific inquiries or purchases.
8. Limitation of Liability
To the maximum extent permitted by law, Heavy Machinery and More and Network Marketer LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
9. Indemnification
You agree to indemnify, defend, and hold harmless Heavy Machinery and More, Network Marketer LLC, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of our services or violation of these terms.
10. Dispute Resolution and Arbitration
Any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the Commonwealth of Virginia. You waive any right to participate in a class action lawsuit or class-wide arbitration.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of modified terms.
